Compensation To Be Paid For Liability
(1) While bearing liability
for a tort committed under this Chapter, the person who commits
the tort shall pay compensation.
(2) Notwithstanding anything contained in sub-section (1),
if any tort is committed under this Chapter as a result of any
omission, fault, recklessness or negligence of the injured person
also, the quantum of such compensation shall be lesser.
(3) The compensation referred to in sub-section (1) shall
be limited to the actual loss or damage, and remote or unactual
compensation shall not be recoverable.
(4) The compensation may be of any type, in the form of
either cash or kind or service.
(5) If any loss or damage is caused under this Chapter, a
person who suffers shall be entitled to claim for compensation,
subject to this Chapter.
(6) If a claim is made for compensation pursuant to subsection
(5), the court may order reasonable compensation to be
paid.
